The Wisconsin Court of Appeals recently upheld a $1 million verdict against a Kenosha manufacturer.

A Kenosha County jury in August 2007 found IEA Inc. liable for the damages, to be paid to Lockport, N.Y.-based Niagara Cooler, Inc.

The jury found IEA Inc. had violated the terms of agreement wherein Niagara was to market and sell locomotive radiators built by IEA.

According to attorneys for Niagara, IEA had also interfered with a supply contract that Niagara was negotiating with National Railway Equipment Co., a locomotive manufacturer.

The jury award included $383,520 in damages for IEA’s contract breach, $254,592 for future damages suffered as a result of IEA’s interference of Niagara’s sales contract with National Railway Equipment and $366,733 in punitive damages.

In addition to affirming the verdict and judgment, the Court of Appeals rejected IEA’s claim that the punitive damage award was excessive.

Kenosha attorney Gino Alia represented Niagara in the case.

Representatives of IEA did not return a request for comment Friday.
